SPOT4DIS TERMS AND CONDITIONS OF USE

1. Purpose

These Terms and Conditions govern the access to and use of the Spot4Dis mobile application (hereinafter, the "Application"), whose purpose is to facilitate the search, consultation and use of public parking spaces reserved for persons with disabilities, as well as to provide associated digital services aimed at improving the accessibility and mobility of its users.

Access to and use of the Application implies full acceptance of these Terms and Conditions.

2. Owner of the Application

The Spot4Dis Application is owned by:

• Association of People with Reduced Mobility (hereinafter "AsoPMR").

3. Conditions of Use

The Application is intended for users over 18 years of age or for minors duly represented by their legal guardians.

Users undertake to use the Application in accordance with:

• Applicable legislation.
• Good faith.
• Public order.
• These Terms and Conditions.

Any fraudulent use or use intended to impair the proper functioning of the platform is strictly prohibited.

4. Access Levels

Spot4Dis offers different levels of access, all of them free of charge.

4.1 Unregistered User

Without creating an account, any user may:

• Search for public parking spaces reserved for persons with disabilities.
• View the parking spaces available in the public database on the map.
• Consult the location of those parking spaces.

Access without registration does not allow the use of personalized services.

4.2 Basic User

In addition to the previous functionalities, the user may access:

• Navigation: Receive navigation guidance to the selected parking space.


• Regulations Information: Access summarized information on parking regulations for persons with disabilities in an accessible, inclusive format adapted to the language selected by the user.
  
  Note: This information is provided for guidance purposes only and does not replace the official regulations published by the competent public authorities.


• Incident Reporting: Users may report incidents related to parking spaces. Spot4Dis may forward such reports to the relevant public authorities or collaborating entities where appropriate.


• Real-Time Availability: Consultation of the availability of parking spaces equipped with IoT sensors. Information is provided in real time whenever the required infrastructure is installed and operational. Spot4Dis does not guarantee that all parking spaces are equipped with sensors or that this service will always be available.


• Suggestion of New Parking Spaces: Registered Users may contribute to the continuous improvement of the platform by proposing the inclusion of public parking spaces reserved for persons with disabilities that are not yet registered in Spot4Dis. To do so, users may submit the following information through the Application:


• The geographical location of the parking space.
• A photograph of the vertical road sign.
• A photograph of the horizontal road marking.
• Any additional information that may facilitate its identification.



Submitting a suggestion does not imply the automatic inclusion of the parking space on the Spot4Dis map. All proposals may be reviewed and verified by Spot4Dis and, where appropriate, by the competent public authorities or collaborating entities before publication.

Users declare that the images submitted have been obtained in compliance with applicable legislation and do not infringe the rights of third parties, particularly regarding personal data protection and privacy.

Spot4Dis may anonymize or remove any content deemed inappropriate or contrary to applicable law.

Suggestions submitted by users are intended to improve the coverage, quality and accuracy of the information provided by the platform for the benefit of the entire community of persons with disabilities.



• Voice Commands: Activation of the voice command system compatible with the Application. Its operation depends on the permissions granted by the user.

4.3 Validated User

Users who meet the requirements established by Spot4Dis may access advanced functionalities. Validation may require verification of supporting documentation or proof of authorization to use parking spaces reserved for persons with disabilities.

Available functionalities may include:

• Parking Space Reservation: Where municipal infrastructure allows, users may reserve a parking space equipped with Smart Barrier devices or other compatible systems. Reservations are subject to the availability of IoT infrastructure, the availability of the parking space, the proper functioning of communications systems, and the conditions established by the public authority responsible for the parking space.
  
  Note: A reservation does not grant ownership rights over the parking space and may be cancelled for technical, security or public interest reasons.

5. Accuracy of Information

Spot4Dis makes reasonable efforts to keep the information up to date. However, some parking spaces may have been modified by public authorities; the information may contain errors; certain parking spaces may no longer exist or may have changed location. Real-time availability depends on the proper operation of sensors, communication networks and municipal systems.

6. User-Reported Incidents

Incidents reported by users must correspond to real events. They may not be used to:

• Submit false reports.
• Defame third parties.
• Introduce unlawful content.
• Include offensive or discriminatory information.

Spot4Dis may remove any communications that do not comply with these Terms and Conditions.

7. User Obligations

Users undertake to:

• Provide truthful information during registration.
• Keep their access credentials secure.
• Not share their account with third parties.
• Use the Application solely for lawful purposes.
• Comply with applicable traffic and parking regulations.

Users shall be responsible for all activities carried out through their account.

8. Service Availability

Spot4Dis will make reasonable efforts to keep the Application continuously available. However, interruptions may occur due to:

• Maintenance work.
• Updates.
• Technical incidents.
• Third-party failures.
• Connectivity issues.

The entity does not guarantee uninterrupted availability of the service.

9. Limitation of Liability

Spot4Dis acts solely as a technology platform. Consequently, it shall not be liable for:

• Traffic fines.
• Parking penalties.
• Decisions adopted by the competent authorities.
• Changes to applicable regulations.
• Parking space availability.
• Errors caused by sensors or IoT devices.
• Failures in third-party navigation services.
• Interruptions caused by telecommunications operators.

Users must always verify the road signage at the parking location. In the event of any discrepancy between the information displayed in the Application and the official road signage, the latter shall always prevail.

10. Data Protection

Personal data will be processed in accordance with the Spot4Dis Privacy Policy and Regulation (EU) 2016/679 (GDPR), as well as any applicable national legislation.

The use of certain functionalities may require:

• Location data.
• Access to the microphone for voice commands.
• Sending notifications.
• Processing of information required to validate the user.

Each permission may be revoked by the user at any time through their device settings.

11. Intellectual Property

All contents of the Application, including:

• Software;
• Design;
• Logos;
• Texts;
• Databases;
• Maps;
• Images;
• Trademarks;

Are the property of AsoPMR and are protected by intellectual and industrial property legislation. Their reproduction or distribution without prior authorization is strictly prohibited.

12. Suspension or Cancellation of Accounts

Spot4Dis may suspend or cancel a user account if any of the following is detected:

• Fraudulent use.
• Breach of these Terms and Conditions.
• Improper use of reservations.
• Manipulation of the system.
• Activities that compromise the security of the platform.

13. Amendments

Spot4Dis may amend these Terms and Conditions in order to adapt them to:

• Legislative changes.
• New functionalities.
• Technical improvements.
• Changes to the service.

The new Terms and Conditions will be published before they enter into force.

14. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by Spanish law. Any dispute arising from or related to these Terms and Conditions shall be submitted to the competent Courts and Tribunals in accordance with the applicable legislation, unless a legal provision establishes a different jurisdiction.
